Classification & Compensation - Fair Labor Standards (FLSA)
The Fair Labor Standards Act applies to all university employees. Part of this act requires the university to determine whether employees are either subject to, or exempt from, its overtime provisions. The status of any particular employee is determined by the Office of Human Resources on the basis of whether the employee's duties, responsibilities and salary meet the requirements for exemption. This is not determined by title, but by the actual work being done and the organizational structure. The Office of Human Resources uses guidance from the US Department of Labor do determine if an employee is exempt from the overtime provisions on the basis of being administrative, professional, or executive. This determination is made when a position is established or studied as part of the classification process.
